Terms of Use

  1. Who do these terms apply to?

    These Terms of Use (Terms) relate to your access to and use of illion Credit Check. By accessing and using illion Credit Check, you acknowledge and agree that these Terms apply.

  2. What is illion Credit Check?

    illion Credit Check is provided by illion Data Registries Pty Ltd, a Credit Reporting Body (illion, we, our, us). illion Credit Check offers the following services to you (subject to you meeting the eligibility requirements) at no cost:

    1. access to your personal credit information held by illion including your credit report and credit score; and
    2. the ability for you to request correction to your credit information if you believe it is incorrect.

    Please note that information made available to you in illion Credit Check does not constitute any form of professional, legal or financial advice. We recommend that you seek your own independent advice before making any decision in relation to any credit product and/or repayment of debts.

  3. Who can use illion Credit Check?

    To be eligible to use illion Credit Check, you must:

    • be at least 18 years old;
    • be acting in your own personal capacity (and not as an agent of or on behalf of anyone else);
    • be able to meet our identity verification requirements; and
    • be a resident of Australia and be able to provide your current residential address in Australia.

    Subject to you meeting the above eligibility criteria, we grant you a non-exclusive, non-transferable, limited licence to access and use illion Credit Check within Australia for your own personal and non-commercial use in accordance with these Terms.

  4. How can you use illion Credit Check?

    In accessing and using illion Credit Check, you must:

    1. provide true and accurate information about yourself; and
    2. keep your login details (e.g. username and password) confidential at all times and not allow any other person to log in to your account. If you become aware of or suspect any unauthorised access to your account, or any security and/or data breach that may result in your login details being compromised, please change your password and contact us immediately.

    We may electronically monitor your use of illion Credit Check to meet our security requirements and to prevent fraud and unauthorised or illegal use.

  5. How do we treat personal information?

    We will collect, use and disclose your personal information in accordance with our Credit Reporting Policy and Privacy Policy, and all applicable privacy laws.

  6. How do we manage intellectual property?

    All intellectual property rights in illion Credit Check (including but not limited to, trade marks, logos and copyright) and all other content and information made available through illion Credit Check (including credit information) (illion Content) are owned by us or our licensors. We do not, at any time, transfer any ownership rights in the illion Content and we reserve all rights not expressly granted. You must not use or distribute any illion Content without our prior written permission.

  7. How is liability determined?

    illion Credit Check is made available to you at no cost and is provided and on an “as is” and “as available” basis. To the extent permitted by law, we are not liable to you or any third party for any loss, damage, claim, cost or expense, whether in tort (including negligence), contract or otherwise and whether direct, indirect, or consequential, as a result of or in connection with your access to or use of illion Credit Check.

    Nothing in these Terms excludes, restricts, or modifies any right, representation, remedy, warranty, condition, guarantee, term or undertaking that would be conferred on you or implied into these Terms by law (including any implied terms, conditions or warranties of satisfactory quality, fitness for a particular purpose, non-infringement, compatibility, security and accuracy) (Mandatory Term). Our liability for a breach of a Mandatory Term is limited to resupply the relevant services.

  8. How can your account be cancelled?

    You may cancel your account at any time by selecting ‘Close my account’ under the ‘My Settings’ section of your account.

    We may, to the extent permitted by law, cancel or suspend your access to illion Credit Check:

    1. if you breach, or we reasonably suspect you have breached, a material term of these Terms. We will give you 5 business days prior notice unless the breach is determined by us to be sufficiently material to warrant urgent cancellation or suspension, or we are otherwise required by a court or regulator to cancel or suspend sooner. If the circumstances that gave rise to a cancellation or suspension are rectified, we will reinstate your access; or
    2. if we identify or reasonably suspect there has been unauthorised, fraudulent or suspicious activity on your account.

    We may, at our discretion, change, cancel or discontinue all or some of the illion Credit Check platform. If we intend to cancel or discontinue any part of the platform, we will provide you with 30 days’ prior written notice (or, if we cannot provide 30 days’ notice, we will provide such notice as is reasonably practicable in the circumstances).

  9. How can these Terms be changed?

    We may update these Terms from time to time by providing you with 30 days’ prior written notice (or, if we cannot provide 30 days’ notice, we will provide such notice as is reasonably practicable in the circumstances). If you do not agree with the updated terms, you may cancel your account at any time. By continuing to access and use illion Credit Check following an update to our Terms, you agree that the updated terms apply.

  10. Are there any other terms which apply?

    Compliance with law: Each party will comply with all applicable laws.

    Jurisdiction: These Terms are governed by the laws of Victoria, Australia. Each party submits to the exclusive jurisdiction of the courts of Victoria, Australia.

    Entire agreement: These Terms constitute the entire agreement between the parties about its subject matter and supersedes all previous agreements and understandings.

    Assignment: Neither party may assign or novate any right or obligation under these Terms without the other party’s prior written consent, except that we may assign or novate these Terms to our related bodies corporate or in connection with a merger (including with a third party), consolidation or reorganisation of our assets.

    Severability: If any part of these Terms is illegal or unenforceable, it will be severed and the remaining terms continue in full force and effect.

    Wavier: A single or partial exercise or waiver of a right relating to these Terms does not prevent any other exercise of that right or any other right.

    Survival: Any term of these Terms which is by its nature a continuing obligation, will survive termination.
